1. Acceptance of Terms
By accessing or using the SURGE Security platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Services
SURGE provides automated forensic analysis services. You may upload forensic collections from endpoints for AI-powered analysis, which produces findings, risk scores, and verdicts. The Services include the web application, API access, and related tools and documentation.
3. Account Registration
You must create an account to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You will not upload data you do not have authorization to analyze; attempt to access other customers' data or interfere with the Services; reverse engineer, decompile, or disassemble any part of the Services; or use the Services to develop a competing product.
5. Billing and Payment
Paid plans are billed monthly. Prices are subject to change with 30 days' notice. Overage charges are billed at the rates specified in your plan. You are responsible for all applicable taxes. Refunds are handled on a case-by-case basis.
6. Data Ownership
You retain all rights to the forensic data you upload to the Services. SURGE does not claim ownership of your data. We process your data solely to provide the Services and as described in our Privacy Policy. Analysis results and reports generated by the Services are licensed to you for your use.
7. Service Availability
We strive to maintain high availability of the Services but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. Enterprise plans include SLA guarantees as specified in the applicable service agreement.
8. Limitation of Liability
SURGE provides forensic analysis results as informational output generated by automated systems. While we strive for accuracy, results should be validated by qualified personnel before being used as the sole basis for security decisions. SURGE shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Services.
9. Termination
Either party may terminate these Terms at any time. Upon termination, your right to use the Services will cease. We will retain your data for 30 days after termination, during which time you may export your data. After 30 days, your data will be permanently deleted.
